Under California law, California residents who have provided personally identifiable information to a company may have the right to request a list of all third parties to whom that company had disclosed such information for the third parties’ direct marketing purposes during the preceding calendar year, along with a list of the categories of Personal Information that had been so disclosed. Currently, MuscleMeds does not disclose the Personal Information collected at this Website with non-affiliated third parties for such third parties’ direct marketing purposes. Any change to this policy will be disclosed in updates to the Privacy Policy. Collection and Use of Information

The Personal Information We Collect.  This Policy applies to all information collected by or submitted to www.musclemedsrx.com.  We consider “Personal Information” to mean information about an identifiable individual.  If you subscribe to our newsletter or mailing list or participate in activities or promotions that may be offered on the Site from time to time, you will be asked to provide a variety of information including, but not limited to, your name, mailing address, email address, phone number, and other similar information about you.

Financial Information This Site does collect your financial information.  Purchases or sales made on this site are governed by the Privacy Policy and/or Terms and Conditions of this Site. Similarly, you may subscribe to newsletters or magazines or visit other websites that are related to or affiliated with this Site and which may collect your financial information.  Such websites are not governed by the Privacy Policy and Terms and Conditions of this Site.  You are encouraged to review the policies and terms of those other websites to understand how your Personal Information, including your financial information, is collected and maintained by such websites.

IP Address.   An IP (Internet Protocol) address is a number that is automatically assigned to your computer by your internet service provider when you log on. Your IP address is not linked to your Personal Information but MuscleMeds does reserve the right to use IP addresses to identify individuals who threaten the Website or other users or visitors.  IP addresses may also be used to help diagnose problems with the Website and to gather broad demographic information.

Third-Party Applications.  Some Users or visitors may connect with the Website using Facebook or Instagram.  If you decide to connect to the Site through an external, third-party application, you will be granting MuscleMeds permission to receive information from such third-party applications.

Other Information.  When you access the Website, MuscleMeds will automatically receive some information about your use of the Website.  The type of information that is automatically collected by MuscleMeds includes such things as the date and time of access of the Website, the Internet protocol (IP) address of the computer that you are using, the domain and host from which you access the Internet, your browser software and operating system, the referring website address, and the kinds of activities you are engaging in on the Website.  This information is used to help us improve and enhance the Website to better meet the needs of its users

MuscleMeds contracts with non-affiliated third parties/business partners to host the Website and to provide data collection and reports regarding Visitors’ activities on the Website. On our behalf, these non-affiliated third parties/business partners use cookies to receive and collect information anonymously (meaning without attaching it to any personally identifiable user) about Visitors’ activities and collect and aggregate such information as collected from many Users of the Website. These non-affiliated third parties/business partners have agreed not to use this information other than (i) in connection with providing services to us to make our Website more useful and efficient, (ii) as permitted in this Privacy Policy, or (iii) as otherwise permitted by law.

MuscleMeds will also aggregate anonymized Personal Information and may use, share and disclose such aggregated information as permitted by law.  For example, we may use such information for research and product development purposes, and may also share such aggregated information with MuscleMeds business partners.

Regardless of whether a User has chosen to limit MuscleMeds sharing of Personal Information as collected on the Website, MuscleMeds may, without restriction, use, share and disclose aggregated statistics about Users, along with specific information concerning individual Users that is not Personal Information in any way permitted by applicable law.

Use of Cookies and Web Beacons; Use of Google Analytics

MuscleMeds uses a web analytics tool called Google Analytics that helps website and mobile application owners understand how visitors engage with their websites.  We can view a variety of reports about how visitors interact with our Website so we can improve it. Google Analytics collects information anonymously.  Google Analytics uses cookies and IP addresses, and reports website trends without identifying individual visitors. In the event a visitor to the Website voluntarily submits contact information to Google Analytics, that company may then associate such information with the applicable IP address to enable us to see that visitor’s specific interactions with our Website. Do Not Track Signals 

Certain web browsers provide users with an option by which you may have your browser send a “Do Not Track” signal to websites that you are visiting, advising the recipient websites that you do not want to have your online activity tracked.  However, the way browsers communicate such “Do Not Track” signals is not yet uniform and, accordingly, our Website does not take any action in response to such signals.  In the event a final standard is developed and accepted, we may reassess how we should respond to such signals.

The MuscleMeds mobile message service (the "Service") is operated by MuscleMeds (“MuscleMeds”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to MuscleMeds’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of MuscleMeds through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with MuscleMeds. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18775480325 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other MuscleMeds mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt-out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any shortcode or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Retention of Personal Information.  Personal Information is retained to deliver our services, to otherwise fulfill identified or apparent purposes, and Personal Information may be retained for record-keeping. At some point MuscleMeds may elect to destroy, erase or anonymize your Personal Information. Once anonymized, we undertake not to re-identify the information.

The Website may contain links to various other sites.
